Apple looses court battle to ban Galaxy Tab 10.1 in The Netherlands
Apple has lost a new court battle in Netherlands over copyright infringement of the Galaxy Tab 10.1 on the iPad. Apple said the Galaxy Tab 10.1 infringed their design patents with it’s rectangular shape with rounded corners but Samsung countered that “Apple was not the first to design a tablet with a rectangular shape and rounded corners,” “No company should have a monopoly on general designs” .
The Supreme Court ruled that “Apple’s design right is valid, but the protection it offers is very limited due to earlier similar designs, also known as prior art”.
The win comes as a boost for Samsung as sales of it’s flagship phone, the Galaxy S4, hit 10 the million milestone last month.
